Acceptance of Terms

By accessing and using SmartWaves services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Description of Service

SmartWaves provides trading indicators, signals, educational content, and automated trading tools designed to work with TradingView and other trading platforms. Our services include but are not limited to technical analysis indicators, market signals, educational resources, and automated trading assistance.

User Accounts and Registration

To access certain features of our services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Payment Terms

All fees for our services are payable in advance and are non-refundable except as expressly stated otherwise. We accept payments in cryptocurrency (Ethereum) and other methods as specified. Prices are subject to change with notice. You are responsible for all applicable taxes and fees.

Subscription fees are billed in advance and automatically renew unless cancelled. You may cancel your subscription at any time, but no refunds will be provided for unused portions of your subscription period.

Prohibited Uses

You may not use our services for any unlawful purpose or to solicit others to perform unlawful acts. You may not violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances. You may not transmit any worms, viruses, or any code of a destructive nature.

You may not use our services to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate. You may not submit false, misleading, or deceptive information. You may not attempt to gain unauthorized access to our services or related systems.

Intellectual Property Rights

The service and its original content, features, and functionality are and will remain the exclusive property of SmartWaves and its licensors. The service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software.

User Content

Our service may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material. You are responsible for the content that you post to the service, including its legality, reliability, and appropriateness.

By posting content to the service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the service.

Service Availability

We strive to maintain high availability of our services, but we do not guarantee that our services will be available at all times. We may experience downtime for maintenance, updates, or technical issues. We are not liable for any losses resulting from service unavailability.

Limitation of Liability

In no event shall SmartWaves, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

Our total liability to you for all damages shall not exceed the amount you paid us for the service in the twelve months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless SmartWaves and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the service and cancel your subscription.

Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which SmartWaves operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
